Review the terms that govern your use of NextcraftAi and our obligations to you as a customer.

1. Agreement to Terms

By accessing or using NextcraftAi (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you are agreeing on behalf of an organization, you represent that you have the authority to bind that organization to these Terms. If you do not agree to these Terms, you must not use the Service.

2. Description of Service

NextcraftAi provides a unified API platform that enables developers to access and manage multiple generative AI models from providers including Google (Gemini), OpenAI (GPT), Anthropic (Claude), and other leading AI providers. Our Service includes:

  • Unified API Access: Single API endpoint and authentication for multiple AI providers
  • Intelligent Model Routing: Automatic routing and failover between AI models
  • Usage Analytics: Real-time monitoring and analytics for API usage
  • Security Controls: Latency guardrails, cost ceilings, and usage policies
  • Billing Management: Subscription plans, invoicing, and payment processing

The Service may be updated, modified, or discontinued at any time without prior notice.

3. Account Registration and Security

3.1 Account Creation

To use the Service, you must create an account by providing accurate and complete information. You must be at least 18 years old or have the legal capacity to enter into contracts in your jurisdiction.

3.2 Account Security

You are solely responsible for:

  • Maintaining the confidentiality of your account credentials and API keys
  • All activities that occur under your account
  • Notifying NextcraftAi immediately of any unauthorized access or use

3.3 API Keys

API keys are provided for your use and must be kept secure. You are responsible for all API calls made using your keys. Do not share API keys publicly or commit them to version control systems.

4. Subscription Plans and Billing

4.1 Available Plans

NextcraftAi offers the following subscription plans:

  • Starter Plan: $12/month with 150,000 tokens included
  • Pro Plan: $39/month with 1,000,000 tokens included
  • Enterprise Plan: Custom pricing with dedicated support and features

4.2 Trial Period

New users may be eligible for a 7-day free trial. During the trial period:

  • Full access to plan features is provided
  • No payment is required
  • Trial automatically converts to a paid subscription unless cancelled
  • You may cancel at any time during the trial without charge

4.3 Billing and Payment

  • Subscriptions are billed monthly in advance
  • Payment is processed through Stripe (USD) or Razorpay (INR)
  • All fees are non-refundable except as required by law
  • Invoices are generated automatically and due within 3 days
  • Unpaid invoices may result in account suspension after 3 days past due date

4.4 Usage Limits and Overage

  • Each plan includes a monthly token allowance
  • Usage beyond plan limits may incur additional charges or service restrictions
  • Enterprise plans may have custom token packages and pricing

4.5 Plan Changes

  • You may upgrade your plan at any time; changes take effect immediately
  • Downgrades take effect at the start of the next billing cycle
  • Enterprise plan changes require approval and custom pricing

5. Acceptable Use Policy

5.1 Permitted Use

You may use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

  • Violate any applicable laws, regulations, or third-party rights
  • Infringe upon intellectual property rights
  • Transmit malicious code, viruses, or harmful content
  • Attempt to reverse engineer, decompile, or disassemble the Service
  • Build competing services that replicate NextcraftAi's functionality
  • Abuse rate limits or attempt to bypass security controls
  • Use the Service to generate illegal, harmful, or offensive content

5.2 Prohibited Content

You may not use the Service to generate content that:

  • Violates laws or regulations
  • Infringes intellectual property rights
  • Contains hate speech, harassment, or discrimination
  • Promotes illegal activities
  • Contains personal information without consent

6. Data and Privacy

6.1 Data Processing

NextcraftAi processes limited data necessary to provide the Service, including:

  • Account information and authentication credentials
  • API usage metadata (endpoints, models used, token counts, latency)
  • Billing and payment information
  • Support communications

6.2 Data Storage

  • We do not store the full content of API requests or responses
  • Usage metadata is retained for analytics and billing purposes
  • Account data is retained according to our data retention policy

6.3 Third-Party Providers

When you use the Service, your requests are forwarded to third-party AI providers (Google, OpenAI, Anthropic, etc.). These providers may process your data according to their own privacy policies. NextcraftAi is not responsible for third-party data handling practices.

7. Service Availability and Performance

7.1 Service Availability

NextcraftAi strives to maintain high availability but does not guarantee uninterrupted access. The Service may be unavailable due to:

  • Scheduled maintenance
  • Unforeseen technical issues
  • Third-party provider outages
  • Force majeure events

7.2 Third-Party Dependencies

The Service depends on third-party AI providers. NextcraftAi is not responsible for:

  • Availability or performance of third-party AI services
  • Changes to third-party APIs or models
  • Pricing changes by third-party providers
  • Quality or accuracy of AI-generated content

8. Intellectual Property

8.1 NextcraftAi Property

All rights, title, and interest in the Service, including software, documentation, and trademarks, remain the exclusive property of NextcraftAi.

8.2 Your Content

You retain ownership of content you generate using the Service. By using the Service, you grant NextcraftAi a limited license to process your content solely to provide the Service.

9. Disclaimers and Limitations

9.1 Service Disclaimer

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

9.2 AI Content Disclaimer

NextcraftAi does not guarantee the accuracy, reliability, or appropriateness of AI-generated content. You are solely responsible for reviewing and validating all content generated through the Service.

9.3 Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, NEXTCRAFTAI SHALL NOT BE LIABLE FOR:

  • INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES
  • LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITIES
  • DAMAGES ARISING FROM USE OR INABILITY TO USE THE SERVICE
  • DAMAGES ARISING FROM THIRD-PARTY AI PROVIDER ISSUES

Our total liability shall not exceed the amount you paid to NextcraftAi in the 12 months preceding the claim.

10. Termination

10.1 Termination by You

You may cancel your subscription at any time through your account dashboard. Cancellation takes effect at the end of the current billing period. No refunds are provided for partial billing periods.

10.2 Termination by NextcraftAi

We may suspend or terminate your access immediately if:

  • You violate these Terms or our Acceptable Use Policy
  • You fail to pay fees when due
  • You engage in fraudulent or illegal activity
  • Required by law or court order

10.3 Effect of Termination

Upon termination:

  • Your access to the Service will be revoked
  • Your API keys will be deactivated
  • Account data will be deleted per our retention policy
  • Outstanding fees remain due and payable

11. Changes to Terms

We may update these Terms periodically to reflect changes in our Service or legal requirements. We will notify you of material changes via email or through the Service. Continued use after changes become effective constitutes acceptance of the revised Terms.

12. Governing Law and Disputes

These Terms are governed by the laws of [Your Jurisdiction]. Any disputes arising from these Terms or the Service shall be resolved through binding arbitration in accordance with [Arbitration Rules], except where prohibited by law.
